Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Sales Connection Engine ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all visitors, users, and clients of our services.

2. Services Provided

Sales Connection Engine provides outbound sales call services, including but not limited to:

  • Appointment setting and lead qualification
  • Outbound call campaigns using client-provided lead lists
  • Sales script development and optimization
  • CRM integration and reporting
  • Dedicated sales development representative (SDR) teams

The specific scope of services will be outlined in a separate service agreement or statement of work.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and up-to-date lead lists and business information
  • Ensure all leads provided comply with applicable laws, including Do Not Call (DNC) regulations
  • Respond to qualified appointments and leads in a timely manner
  • Provide necessary access to CRM systems and tools as required
  • Communicate campaign goals, ideal customer profiles, and feedback promptly

4. Payment Terms

Payment terms, pricing, and billing schedules will be defined in your service agreement. Unless otherwise stated, invoices are due upon receipt. Late payments may be subject to a fee of 1.5% per month on the outstanding balance. We reserve the right to suspend services for accounts with overdue balances exceeding 30 days.

5. No Guarantee of Results

While we strive to deliver high-quality outbound call services, we do not guarantee specific results, including number of appointments booked, conversion rates, or revenue generated. Results depend on many factors including lead quality, market conditions, offer strength, and client responsiveness. Past performance is not indicative of future results.

6. Confidentiality

Both parties agree to keep confidential all proprietary information shared during the engagement, including but not limited to business strategies, lead lists, call scripts, pricing, and client data. This obligation survives the termination of any service agreement for a period of two (2) years.

7. Intellectual Property

All materials, scripts, processes, and methodologies developed by Sales Connection Engine remain our intellectual property unless explicitly transferred in writing. Clients retain ownership of their lead lists, customer data, and proprietary business information.

8. Termination

Either party may terminate services in accordance with the terms outlined in the service agreement. In the absence of a specific termination clause, either party may terminate with 30 days written notice. Upon termination, all outstanding invoices become immediately due, and we will return or destroy any client data in our possession within 30 days.

9. Limitation of Liability

To the maximum extent permitted by law, Sales Connection Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to the use of our services. Our total liability shall not exceed the amount paid by the client in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Sales Connection Engine, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these terms, your use of our services, or the lead data you provide to us.

11. Compliance

We comply with all applicable federal and state regulations governing telemarketing and outbound calling, including the Telephone Consumer Protection Act (TCPA) and FTC Telemarketing Sales Rule. Clients are responsible for ensuring the leads they provide are legally contactable and compliant with DNC lists.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
